Otchi Terms of Service (English)

Article 1 (Purpose)
These Terms govern the rights, obligations, and responsibilities between the operator of Otchi (the "Operator") and users in connection with the use of the mobile application Otchi (the "App").
Article 2 (Definitions)
"App" means the mobile application Otchi provided by the Operator, which allows users to gather links and images to content scattered across social media and websites in one place, organize them, and find them again.
"User" means any person who uses the App under these Terms.
"Operator" means the individual developer who develops and provides the App.
"Saved Items" means the links and images a user saves in the App, the information collected or generated from them (title, author, excerpt, thumbnail image, and the like), and the memos a user writes.
"Board" means a grouping a user creates within the App to organize Saved Items.
"Backup File" means a file containing all Saved Items, created by the user through the App's export function.
Article 3 (Effect and Amendment of Terms)
These Terms take effect upon publication of this document and notice within the App.
The Operator may amend these Terms within the scope permitted by applicable laws, including the Act on the Regulation of Terms and Conditions.
When amending these Terms, the Operator will specify the effective date and reason for the amendment and post them on this document page at least 7 days before the effective date (at least 30 days for amendments unfavorable to users). Because the App has no sign-up or sign-in and the Operator therefore holds no contact information for individual users, notice on this document page and in-app update notices substitute for individual notice.
A user who continues to use the App after the effective date of amended Terms is deemed to have agreed to them. A user who does not agree may discontinue use by deleting the App.
Article 4 (Description of Services)
- The App provides the following functions:
- Saving content by pasting a URL or through the share function of another app
- Collecting and organizing publicly available information from a saved URL, such as title, author, excerpt, and thumbnail image
- Saving images from the device (screenshots and the like) and extracting text from them through on-device optical character recognition (OCR)
- Organizing items into boards, writing memos, and searching Saved Items
- Suggesting how to organize items, performed on the device, and notifying the user of the results
- Playing saved video content within the App
- Exporting and importing a Backup File containing all Saved Items
- Other supplementary functions the Operator may add
Article 5 (Formation of the Agreement and Use of the Service)
The App may be used free of charge without any sign-up or sign-in procedure.
A user is deemed to have agreed to these Terms by installing and using the App.
Because the App maintains no account identifying the user, no separate age restriction is imposed. Use of the App is subject to the age rating set by the App Store and to the settings of the user's device.
The Operator may introduce paid features or in-service advertising in the future, in which case advance notice will be given through an App update and an amendment to these Terms and the Privacy Policy. Features already provided will not be converted to paid features afterward.
Article 6 (Absence of Accounts and Storage of Data)
Saved Items are stored only on the user's device and are not transmitted to any server operated by the Operator. The Operator cannot access and does not retain a user's Saved Items.
As a consequence of the preceding paragraph, the Operator cannot restore a user's Saved Items. The user is responsible for guarding against data loss arising from loss or reset of the device, deletion of the App, or replacement of the device, and should do so using the App's export function or the device backup provided by iOS.
A user may delete all Saved Items at any time from the App's settings. Deleting the App also deletes the data stored on the device.
Details regarding the processing of personal information are governed by the Privacy Policy.
Article 7 (Access to External Sites and Accuracy of Information)
The core function of the App is to retrieve publicly available information from a URL the user specifies, and in doing so the App connects directly to that website. As a result, the website may learn the user's IP address and connection information. This is the same kind of connection as opening the same URL in a web browser, and it does not pass through any server operated by the Operator.
Titles, authors, excerpts, images, and similar information displayed by the App are retrieved and processed from publicly available information on websites operated by third parties, and may not be updated in real time.
Depending on changes to the source site's policies or page structure, sign-in requirements, access restrictions, server failures, or network conditions, information may not be collected, may be collected only in part, or may differ from the actual content. The Operator does not warrant the accuracy, completeness, or timeliness of collected results.
If content is deleted or made private at the source site, images in existing Saved Items may no longer be displayed and their information may no longer be updated.
Article 8 (Third-Party Content and Intellectual Property)
Copyright and other intellectual property rights in the App itself (design, source code, logo, and the like) belong to the Operator.
Copyright in the titles, author names, excerpts, thumbnail images, and the videos and images a user saves belongs to the respective copyright holders or service providers. The Operator claims no rights in such content.
Saving content in the App presupposes private use by the user for the purpose of viewing it again. A user must not reproduce, distribute, transmit, publicly transmit, or commercially exploit third-party content collected or stored through the App without the permission of the copyright holder, and bears responsibility for doing so.
A user must also comply with the terms of service of each content provider (for example YouTube, Instagram, X, Threads, Facebook, and Naver) when using the App. In particular, the terms of service of the relevant video service also apply when a video is played within the App.
Copyright in memos and other works a user creates in the App belongs to the user. Because such works are stored only on the user's device, no license of any kind is granted to the Operator.
Article 9 (On-Device Processing and Organization Suggestions)
To help organize Saved Items, the App may analyze text such as titles and excerpts to suggest boards, recognize text in images, and summarize content or extract keywords.
All processing described in the preceding paragraph is performed on the user's device, and Saved Items are not transmitted to the Operator or to any third-party server in the process. Some functions may be unavailable depending on the device and operating system version.
Boards and classifications suggested by the App are for reference only, and their accuracy is not warranted. Whether to accept a suggestion is entirely the user's decision, and suggestions the user does not accept are not applied to Saved Items.
The App may send device notifications to inform the user of organization suggestions and the like. A user may turn notifications off at any time in the device settings or in the App's settings.
Article 10 (Exporting and Importing Backup Files)
A Backup File created by export is stored on the user's device and is not transmitted to the Operator.
A Backup File contains the user's saved content as it is. If the user shares this file with another person or an external service, the user bears responsibility for doing so.
Import applies the contents of a Backup File selected by the user to the App. The user must verify the target file and the scope of the import beforehand, and the Operator is not responsible for changes to existing data resulting from the user's choice.
Article 11 (Obligations of Users)
- A user must not:
- Reverse engineer, decompile, or disassemble the App, or extract its source code
- Send large volumes of requests by abnormal means so as to burden the App or a source site's servers
- Redistribute or commercially exploit third-party content collected through the App without the rights holder's permission
- Save or use content that infringes the copyright, portrait rights, reputation, or other rights of others
- Save or use content prohibited by law
- Otherwise violate applicable laws
Article 12 (Suspension and Modification of Services)
- The Operator may temporarily suspend, modify, or terminate all or part of the Service in the following cases:
- Maintenance or improvement work necessary to operate the App
- Policy changes, access blocking, or service termination by a content provider
- Changes to operating system or device policies
- Force majeure or other unavoidable circumstances
Where the content of the Service is materially changed or its provision is terminated, the Operator will give advance notice of the reason and timing on this document page. Where unavoidable circumstances such as force majeure apply, notice may be given afterward.
Even if the Service terminates, data stored on the user's device remains under the user's control, and the user may preserve it using the export function.
Article 13 (Limitation of Liability)
The Operator is not liable where the Service cannot be provided due to causes not attributable to the Operator, such as force majeure, policy changes by content providers, or communication failures.
The Operator is not liable for the reliability or accuracy of third-party information a user collects or stores through the App, or for the user's judgments based on such information.
The App is provided free of charge, and the Operator disclaims liability for damages arising from a user's use of or inability to use the App to the maximum extent permitted by applicable law.
Notwithstanding the preceding paragraphs, the Operator is not relieved of liability for damages caused by the Operator's intent or gross negligence.
Article 14 (Dispute Resolution and Governing Law)
Where a dispute arises in connection with these Terms, the Operator and the user will endeavor to resolve it through good-faith consultation.
Where consultation fails, the dispute is governed by the laws of the Republic of Korea and is to be brought before the court having jurisdiction under the Civil Procedure Act.
